Reminder and Warning on Price Practices in Sanqingshan UGGp during the May Day Holiday

With the upcoming May Day holiday, in order to further maintain price order in the tourism market and effectively protect the legitimate rights and interests of operators and consumers, the Sanqingshan UGGp Branch of Shangrao Municipal Administration for Market Regulation hereby issues the following reminder and warning to all operators and relevant units in the region:
 
I. Strict Self-Discipline and Law-Based Operation
All hotels, guesthouses and tourism operators must strictly abide by the Price Law of the People's Republic of China, the Regulations on Administrative Penalties for Price Violations, the Provisions on Clear Pricing and Prohibition of Price Fraud and other laws and regulations. They shall follow the principles of fairness, legality, honesty and trustworthiness, actively fulfill social responsibilities, strengthen price self-discipline, operate in good faith in accordance with the law, and consciously maintain market price order.
 
II. Reasonable Pricing and Prohibition of Collusion
Operators shall properly exercise the right to set prices for hotel rooms, implement reasonable pricing, fair transactions and honor commitments. It is prohibited to follow others to raise prices arbitrarily, increase prices on the spot, spread price-hiking information, or drive up prices. It is also prohibited to jointly raise prices through collusion such as agreements, resolutions or coordination.
Operators must provide consumers with comprehensive, true, accurate and timely information on goods or services to protect consumers’ right to know and right to choose.
 
III. Strict Implementation of Clear Pricing System
Publicized prices must be conspicuous, easy to understand, true, clear and specific. Vague or ambiguous expressions that mislead consumers are prohibited. Price fraud, false promotion and price discrimination are strictly forbidden.
 
IV. Consciously Accept Social Supervision
Operators shall implement all requirements of the market supervision authorities on further regulating market price practices, consciously accept supervision by consumers and news media, and actively cooperate with supervision and inspection by market supervision departments.
 
V. Strictly Abide by Price Commitments
Operators shall not unilaterally break a contract or arbitrarily raise prices after a room reservation order takes effect on e-commerce platforms. They shall not mislead or defraud consumers, nor charge any unstated fees afterwards.
 
VI. Legal Liability
The market regulation authorities will strengthen supervision and inspection over pricing practices in key areas and relevant industries, closely monitor price changes, and severely punish illegal and irregular pricing acts.
Operators who fail to implement government-set prices or government-guided prices shall be subject to a fine of up to five times the illegal gains or a maximum fine of 2 million yuan;
Those in violation of the provisions on clearly marking prices shall be subject to a fine of no more than 5,000 yuan;
Those engaged in collusive pricing shall be subject to a fine of up to five times the illegal gains or a maximum fine of 5 million yuan; 
Those engaged in price gouging shall be subject to a fine of up to five times the illegal gains or a maximum fine of 3 million yuan;
Those engaged in price fraud shall be subject to a fine of up to five times the illegal gains or a maximum fine of 500,000 yuan;
Typical cases of illegal pricing with vile nature and serious circumstances shall be publicly exposed to the public.
Consumers and all sectors of society are welcome to supervise the pricing practices of operators. If you discover any illegal pricing acts, please keep relevant evidence and promptly call 0793-96373 or 12315 to file a complaint or report.
