Interim Measures for the Administration of Environmental Protection in Sanqingshan
Article 1
In order to further strengthen the management and protection of the World Heritage Site and achieve the sustainable development of the scenic area, these interim measures are formulated in accordance with the relevant provisions of the Environmental Protection Law of the People's Republic of China, the Law of the People's Republic of China on the Prevention and Control of Water Pollution, the Law of the People's Republic of China on the Prevention and Control of Atmospheric Pollution, the Trial Measures for the Management of the City Appearance and Environmental Sanitation of the Central District of Shangrao City, and the Regulations on the Administration of Sanqingshan Scenic Area, and in light of the actual conditions of the scenic area.
Article 2
These measures shall apply to the Sanqingshan Scenic Area. All units and individuals within the area shall comply with these Measures.
Article 3
Administrative Responsibilities for Environmental Protection
The administrative department of the scenic area shall be responsible for environmental sanitation, air pollution prevention and control, and sewage treatment in public areas within the core scenic area and service areas.
The township and sub-district offices shall be responsible for environmental sanitation, air pollution prevention and control, and sewage treatment in public places under their respective jurisdictions.
All units and enterprises based on the mountain shall be responsible for environmental sanitation, air pollution prevention and control, and sewage treatment within their own premises, the surrounding 30-meter perimeter, and along the ropeway and its surrounding 30-meter perimeter.
The construction unit shall be responsible for environmental sanitation, air pollution prevention and control, and sewage treatment within each construction site, its surrounding 30-meter perimeter, and during the transportation of materials.
The Huanshan Highway Administrative Office shall be responsible for the environmental sanitation of the Huanshan Highway.
Article 4 Administration of Environmental Sanitation
The following acts affecting environmental sanitation are prohibited:
Spitting or defecating in public places;
Littering waste such as melon peels, fruit pits, cigarette butts, paper scraps, chewing gum, beverage cans, and plastic bags;
Dumping garbage, sewage, feces, animal carcasses, or other debris in public places such as walking trails, streets, riverbanks, sewers, or green spaces;
Burning leaves, garbage, or other waste;
Discarding hazardous wastes such as used batteries, fluorescent tubes, and electronic display screens;
Other acts affecting environmental sanitation as prescribed by laws and regulations.
Construction sites shall install temporary environmental sanitation facilities such as enclosures, temporary toilets, and garbage collection containers in accordance with relevant provisions; construction waste and soil shall be removed promptly, and measures shall be taken to prevent dust and sewage from polluting the surrounding environment. Construction sites must complete anti-pollution preparations before commencement to avoid road pollution caused by mud on vehicles, specifically:
Harden the construction site and set up access passages; install vehicle washing and drainage facilities at the entrances and exits of the construction site, arrange for a corresponding number of cleaning personnel, and equip necessary lighting facilities to ensure that vehicles leaving the site are clean;
Idle construction sites shall be tidied up and, where necessary, covered in a timely manner;
Upon completion of the construction, waste materials shall be removed, the site shall be cleaned, and temporary environmental sanitation facilities shall be dismantled in a timely manner.
It is prohibited to establish business operations that pollute the environment in scenic areas and service areas, such as waste collection, vehicle maintenance, vehicle cleaning, and building materials processing.
Fireworks and firecrackers shall be set off in compliance with the provisions of relevant laws, regulations, and rules. After setting off fireworks and firecrackers, the site shall be cleaned up promptly to keep the ground clean and tidy.
Roads and other public places in core scenic areas and service areas shall be cleaned full-time; public places in the areas under the jurisdiction of townships and sub-district offices, as well as the road surface of Huanshan Highway, shall be cleaned regularly to maintain cleanliness.
It is prohibited to raise poultry, livestock, or edible pigeons (such as chickens, ducks, geese, rabbits, sheep, and pigs) in core scenic areas and service areas.
Hazardous wastes containing viruses, germs, other highly toxic or radioactive substances generated by medical outpatient units and other institutions shall be collected, transported, and disposed of separately in accordance with relevant national provisions, and shall not be mixed with domestic waste in the scenic area.
No unit or individual may dump, pile up, or dispose of construction waste or engineering muck without authorization. Units and individuals that need to pile up or dispose of construction waste and engineering muck shall apply to the administrative department of the scenic area and may only do so after obtaining approval. Waste generated from construction, residential house repair, renovation, and demolition shall be piled up separately at approved sites and shall not be dumped into garbage collection points.
Vehicles transporting bulk materials such as construction waste, building materials, soil, sand and gravel, industrial waste residue, and residual sludge shall be transported in a closed manner, preventing spillage, leakage, or scattering along the way. Vehicles shall not be driven with mud on their wheels.
Domestic waste shall be disposed of in accordance with the principles of harmless treatment, reduction, and resource utilization. Domestic waste generated by all units, fairs, catering and fruit stalls, individual restaurants, residential courtyards, and households shall be collected in garbage bags, sealed, and placed at designated points. It is strictly prohibited to litter or dump garbage on streets, or to place cleaning tools such as buckets, brooms, and mops at doorways.
A fee system shall be implemented for domestic waste disposal. Units and individuals generating domestic waste shall pay domestic waste disposal fees. The supervision of domestic waste disposal fees shall be strengthened, and specific fee management measures shall be formulated in accordance with relevant provisions.
Catering service operators shall not operate outside their designated premises. Catering service operators must take measures to prevent oil fumes and sewage from polluting the living environment of nearby residents.
Article 5 Sewage Treatment
The administrative department of the scenic area shall be responsible for the treatment of sewage generated in public places of core scenic areas and service areas in accordance with the requirements of relevant national provisions.
Each unit and enterprise based on the mountain shall formulate a treatment plan for sewage and oil pollution generated by its own activities, submit it to the environmental protection department of the scenic area for approval, and fund the treatment independently.
The township and sub-district offices shall be responsible for the treatment of sewage generated in public areas under their jurisdiction.
Article 6 Air Pollution Prevention and Control
The administrative department of the scenic area shall be responsible for the monitoring and control of air quality in public places of core scenic areas and service areas.
All units and enterprises based on the mountain shall carry out air pollution prevention and control work in accordance with the requirements of relevant national laws and regulations, and shall promote the application of clean energy in accordance with the requirements of the administrative department of the scenic area.
Townships and sub-district offices shall guide the public in promoting and applying clean energy such as biogas, electricity, and gas to maintain a clean environment.
Article 7 The administrative department of the scenic area shall be responsible for the supervision and administration of environmental sanitation, air pollution prevention and control, sewage treatment, and other related work in core scenic areas and service areas in accordance with the provisions of relevant laws and regulations. The administrative department of the scenic area shall be equipped with professional environmental protection technicians and monitoring equipment to effectively monitor the air quality and sewage discharge of all units.
Article 8 Penalty Provisions
Whoever violates the provisions of these Measures and commits any of the following acts shall be ordered by the administrative department of the scenic area to rectify the illegal act and shall be punished in accordance with the following provisions:
A fine of RMB 10 to RMB 50 shall be imposed for spitting, defecating in public places, or littering waste such as fruit peels, paper scraps, cigarette butts, and broken glass;
A fine of RMB 50 to RMB 100 shall be imposed for piling up garbage at non-prescribed places;
Anyone who raises poultry and livestock such as chickens, ducks, geese, rabbits, sheep, and pigs in core scenic areas and service areas shall be ordered by the administrative department of the scenic area to dispose of them within a time limit or have them confiscated, and may be fined RMB 50 to RMB 500;
A fine of RMB 50 to RMB 500 shall be imposed on operators of mobile catering stalls who fail to clean up and collect the waste generated by their activities in accordance with provisions;
A fine of RMB 50 to RMB 500 shall be imposed for littering animal carcasses or burning leaves, garbage, or other waste indiscriminately;
A fine of RMB 200 to RMB 1,000 shall be imposed if a construction site is not enclosed or construction garbage is not removed promptly;
Anyone who causes leakage or scattering during the outward transportation of residual soil or the transportation of building materials from the construction site, resulting in road surface pollution, shall, in addition to cleaning the polluted surface, be fined RMB 500 to RMB 1,000;
If a catering service operator fails to take effective pollution prevention and control measures, resulting in environmental pollution caused by discharged oil fumes, the administrative department of the scenic area or other administrative law enforcement departments shall order them to cease the illegal acts, make corrections within a specified time limit, and impose a fine of not more than RMB 50,000;
Any unit or individual that lacks air pollution prevention and control facilities or causes an air pollution accident shall be punished by the administrative department of the scenic area in accordance with relevant national laws and regulations;
Any unit or individual that lacks sewage treatment facilities, has damaged or abnormally used sewage facilities, or discharges sewage covertly shall be punished by the administrative department of the scenic area in accordance with relevant national laws and regulations;
Anyone who insults or assaults the administrative staff of the scenic area, if constituting a violation of public security administration, shall be punished by the public security organ in accordance with the Law of the People's Republic of China on Administrative Penalties for Public Security; if the act constitutes a crime, criminal liability shall be pursued in accordance with the law.
Article 9 The administrative department of the scenic area shall be responsible for the interpretation of these Interim Measures.
These Interim Measures shall come into force as of the date of promulgation.
